The Pennsylvania Supreme Court has agreed to hear the appeal of a man accused of killing his wife and then faking an all-terrain vehicle accident to cover up the slaying.
The high court agreed to hear arguments on admission of a note authorities said was written by the victim hours before her death.
Prosecutors in York County allege that 46-year-old Joseph Fitzpatrick III drowned 43-year-old Annemarie Fitzpatrick in a Chanceford Township creek in June 2012.
The defense calls itself "incredibly excited" by the decision. Prosecutors say they are "extremely confident" the conviction will be upheld.
