An investor seeking to put a casino near Gettysburg has lost an appeal of the decision awarding a license to a southwestern Pennsylvania's Nemacolin Woodlands Resort.

The state Supreme Court on Monday denied the appeal by Mason-Dixon Resorts, L.P., of the decision that awarded a casino license to the Nemacolin Resort outside Pittsburgh.

Mason-Dixon had appealed the Pennsylvania Gaming Control Board's decision last year granting the Fayette County resort a license. The board said it believed Nemacolin Resort was the "best fit" for a license and had the most revenue potential.

Nemacolin is now free to being construction. A spokesman says it will take several weeks for work to begin and between nine months and a year for construction to wrap up.
